As Christmas and elections approach, the taxman also cometh, and is very much in the news.
We know about Oplan Kandado, where establishments not paying their proper tax liabilities have been conspicuously padlocked – and that is a good development, because it means that the BIR is saying it means business. Nothing under the table. The BIR is hitting tax cheats where it hurts – by temporarily closing their operations, and by exposing them to public scrutiny. And now we have the Operation Santax Claus, which is really nothing but the stricter implementation of already existing rules and regulations on tiangge (bazaars) and other similar retail operations. Finally, there is the campaign withholding tax plan of the BIR, where politicians and political parties are challenged to show their civic spirit by withholding 5 percent of their payments to suppliers and other campaign contractors like TV and radio stations for immediate remittance to the government. There's nothing wrong with that in principle and, actually, it shoots two birds with one stone: it forces the politicos to also put their money where their mouths are and ensures that the government gets the tax revenues it is entitled to according to the laws these politicians themselves have passed. It also leaves a paper trail as far as campaign expenditure reports are concerned. Is this campaign withholding tax set to harass opposition candidates? Is this campaign withholding tax plan some sinister plan by the administration to harass Opposition candidates? I don't think so. It applies to all candidates, after all. As of September 2009, the revenue shortfall is estimated to be P39 billion. The reported revenue shortfall – the difference between actual and targeted tax revenues – is estimated to be P39 billion as of September. How much of that will Operation Santax Claus be able to recover? Actually nothing because the BIR doesn't expect to get anything. They just wanted to catch into the tax base these retailers who come in for tiangge operation, etc. So, let's go to the next one which is the campaign contribution withholding tax. Here the BIR has a firm amount it expects to collect, but P1.4 billion is less than 5 percent of what should be raised in terms of trying to get the shortfall to close. Are there alternative operations or Oplans that would raise more than that P1.4 billion? The Answer is YES. I will give two examples, both of which will raise at least P20 billion a year. One needs legislative action, but the legislative action required is very simple. It has to do with the tax on cigarettes and tobacco. All the legislature has to do is to change the definition of what we call "the net retail prices" that are used as the basis for determining the specific tax on cigarettes. Currently, those net retail prices are based on October 1, 1996 retail prices. So if you remove that October 1, 1996 retail price and you use current net retail price, you'll get P20 billion a year additional. Can you imagine that up to now, the net retail price the BIR uses by law to determine the excise tax for a pack of cigarettes is still the net retail price 12 years ago, except for the cigarette manufacturers that started after the law was passed. Is it any wonder Philippine cigarette taxes are practically the lowest in the world? That's P20 billion. The second measure – which also will also yield at least P20 billion a year – is to put a stop to the smuggling of oil products in the Philippines. How could that be achieved? It is not as hard as one thinks. There are measures like putting a dye in the imported oil products directed at the export zones like Subic and Phividec, supposedly for so-called "constructive exports." If oil products being sold locally have this dye, then obviously these are smuggled. Another measure is to check gasoline stations at random and see whether they are issuing VAT-registered receipts. Still, another is to clamp down on the three areas that are reputed to be the main recipients of smuggled products: Subic, Phividec in Misamis Oriental, and an oil terminal in Bataan. Still another is to accompany the ships out of these places that are supposed contain oil products for re-export until they are out of Philippine waters. But now, the final question: Why concentrate on Santax and campaign? If this is indeed the case, why concentrate on Santax and campaign taxes? Answer: Because the ones paying the taxes here are the small and medium enterprises; whereas if you stop oil smuggling and use current net retail prices as base, you will be tangling with very big fish – the tax cheats and their even bigger government protectors. I guess Mareng Winnie is right with her answer... the government concentrates on the small ones because they have little influence on the politician pockets. Galawin mo ang mga oil smugglers and cigarrete manufacturers di mababawasan ang milyones ng mga sinasabing protectors. There is a simple and easier answer but no one has the political will and especially the integrity to do it. We can only dream and pray for miracles.....
i´d understand why present gov´t want to tax campaign funds and donations to measures where the said funds came from.
there are so many anonymous donors of funds that present gov´t afraid it could be used against their canditates and the only way they could beat that thru taxing it...smart move is it! big companies doesn´t benefits much from the gov´t,they benefits much from consumers and if gov´t would not tax them as high as heaven,they have no reasons to increase the prices so often. if the consumers want to reduce prices of fossil oils,basics commodities,medicines etc.then they have to sacrifice a bit not to depend on the said products,the consumers has to beat them not them to beat the consumers. kaya inaabuso rin ng mga mapagsamantalang kompanya ang mga tao dahil alam nila kailangan ng mga tao kaya tinataasan nila ng husto ang presyo para kumita sila ng malaki at ganon rin ang ginagawa ng mga nasa gobyerno ang hingan sila ng malaking lagay kung ayaw nilang ipasara ng gobyerno ang kanilang kompanya. sa totoo lang kayang-kaya ng gobyerno lutasin ang problema kaya lang pabor din sa gobyerno ang ginagawang pagtaas ng mga bilihin dahil additional income yon sa kanila. Regular employee or business owners, pag sasapit na ang bayaran sa BIR, namomoroblema na....
Sa States, pay back time for the regular employee.... Kasabihan nayan.."kapag nakapag trabaho kasa BIR lalo na auditor sa mga sa mga resibo sa mga kumpanya or maging sa maliliit na establishimento..currupt.. 5% tax campaign ok yan biruin ba naman bilyon bilyon ang mga ginagasatos nila kahit papaano ay kikita ang gubyerno..at sana may pag lalaanan ang kikitain sa campaign tax.. mahirap kasi hindi na uso ang good president..pati nga sa senado may mga "paso" at mga goons..sayang ang fork barel na ibinibigay sa kanila..hirap kasi sa mga kababayan natin kung bakit iyong mga alam nilang goons at mga pipi sa senado ay ibinoboto.. Tapos walang pinag gagawa sa senado kung di pasikatan lang.. walang batas na maipatupad na maganda..at ang pangit pa dati magkakampi tapos magkakaaway pala..pinag loloko nyo ang taong bayan.. Sana ang gawin ng gubyerno sa tax campaign ay may paglalaanan para ang taong bayan kahit papaano ay alam kung saan mapupunta ang 5% na kikitain sa eleksiyon.. Ayoko ng 5% tax campaign di naman para sa akin yon,sa kanila yon., sa mga "kurakot team." Ang mga ordinaryong tao lang na sumusweldo ng kinsenas-katapusan ang kayang dik-dikin ng BIR.....
Ang mga malalaking negosyante, ewan ko na lang...... Madalas pang mang harras ang BIR pag di kaagad naka bayad ang ordinaryong empleyado....Padadalhan ka kaagad ng sulat....May halong pananakot.... I so agree! AMEN! If you will only go and observe in the BIR you will pity the small entrep who are charged so much, til they decide to close business. If the government will help small business, go for the big fish because small entreps tried to pay the right tax coz they are afraid. I really cant understand why politicians, smugglers have no conscience.

Papaano kapag ginawang ligal yan maraming magagalit at "WAR" ang deklarasyon.. Mula sa pinaka mababa hangang sa pinaka mataas may KOTONG.. Kapag ginawang ligal ang huweteng.. sa malamang gagawat gagawa ang mga namamahala sa huweteng na paraan para ibagsak sa puwesto ang presidente ng Pinas.. kaya kung ano ang "tugtog iyon ang sayaw".. Si Erap lang ang bobo ginaya ang stle ni Marcos..si Marcos gumawa muna ng plano bago dumampot ng pera.. I really admire Mareng Winnie for being such a wonderful source for novel ideas such as these on alternative tax collection measures and for countless other suggestions/comments coming from her, all directed to better Philippine economics. Unfortunately, her Congressman and other lawmakers who may happen to tread on these gems do not believe so. Otherwise they will be scrambling to have the playing rules changed such that to benefit every Filipino.
Wwe gripe about these politicians/lawmakers every time, all the time but we do not learn a simple lesson. We keep putting these same people into positions of "power" each election time while we all know that they use their borrowed powers on something else - for their, not for our advancement. Wanna fight back??? Here are a few suggestions, if I might: 1. Do not vote in the coming elections. True, the bad candidates will have an advantage but don't sweat it out, everything will even out at the end. 2. Avoid paying for any kind of tax. Ku-kurakutin lang naman nila yung tax money mo, so keep it for yourself na lang. Use your money for something good. Examples: Minimize purchases which invite the 'value added tax' (VAT). Minimize shopping for "branded" items or for ANYTHING that comes with a receipt. Buy your stuff from the neighborhood palengke - food & non-food or grow your own if possile. Avoid imported goods. Minimize your phone calls/text messages. Minimize your car usage, try the public transport. Minimize your smoking and drinking (if you indulge in such) to avoid paying that 'sin' tax. In other words - save YOUR money, put it in a bank and at the same time shred your ATM and credit cards to pieces. You won't need them anymore. There are so many other things that I can add to this list but probably the most important thing to remember is: Try very hard to avoid being in a position where you might be "forced" or induced to provide some 'elbow grease'. IOW, Kotong or Patong. Obey the laws or simply follow your good breeding traits, be good, keep a simple lifestyle and a low profile. You ask: After all the above efforts what's in it for me, for us? It's really simple, corruption in government revolves around money so if there's very little of it going around, courtesy of you and me, then those who yearn for power will lose their appetites for positions of power in government (and big business) because it will no longer be profitable for them to stay. Afraid of going back to how our parents/grandparents lived/survived in the good old days? Maybe this is the time, your one chance in your lifetime...to set things right. Many are running even if they don't expect to win, so they can launder their ill gotten wealth and claim it came from campaign donations. The money was deposited in other accounts to be transferred back to them during the campaign period. Voila! the money is laundered even better than Tide or Mr Clean

Ginagawa nila ito para makaiwas sa VAT..kaya ang pera na sana ay kikita ang gubyerno ay nanakaw pa..kaya nga kasabihan na pag sa BIR ka nag work at auditor ang toka ay marami talagang anumalya..dino-doctor ang mga resibo para makabawas sa buwis.. Kaya ang ginagawa ng gubyerno para maka-bawi sa gastusin sa mga opisyales at iba pa ay gagawa ulit sila ng panibagong idea na TAX para makalikom ng pera.. Ang kawawa ang taong bayan.. Kaya kahit saang sulok ng Pinas ay bukang bibig ng tao ay "napaka mahal ng bilihin" kaya halos lahat ay gustong mag-trabaho sa abroad.. Puwede namang maiwasan kahit papaano ang mga currupt sa gubyerno. Dapat lahat ng transaksiyon at bayarin ng gubyerno maliit man at malaki ay dapat sa bangko dadaan, at ang bangko ay mag bibigay lang ng katibayan na nakapag bayad na.. Then ang ibinigay na valid papers na galing sa bangko ang siyang ibibigay sa naturang bayarin..kaya "walang money involve sa mga ahensiya ng pamahalaan..pati fixer (kotong)ay mawawala na.. Kung mag papatuloy ang lumang sistema ay "DATING GAWI"ulit tayo..at mapapaos ulit sa kakasigaw.. May idea ako regarding merchants who do not issue official receipts. Para makabawi naman ang taong bayan -- Why not ask the merchant for a 12% direct discount off the total purchase price in return for the non-issuance of a receipt?
Reality Check: The merchant has already slapped his profit on top of the base price of the item purchased PLUS he gets to pocket an additional 12% intended for the VAT. Double-Jeopardy on the part of the purchaser, double profit for the merchant, Zilch for government! Think that'll work??? Tama si eden...Di nag bibigay ng resibo ang mga negosyante kaya di ma trace ang dapat bayaran ng mga taong yan.
May suggestion din ako sa mga mambabatas. Dapat mag formulate sila ng batas na kung sino ang mahuli/mapatunayan na lumabag sa di pag issue ng resibo, pagmultahin kaagad o kaya'y ipasara ang negosyo nya dahil pang loloko nya sa gobyerno. Ang simpleng picture sa cellphone or any proof na makakapag patunay na binili nga ng isang consumer sa isang establishment isang produkto, ay sapat ng maging batayan...Huwag ng daanin pa sa korte dahil lalo lang tatagal, lalo lang mawawalang saysay dahil ang justice system mismo, may butas. BIR should intensify tax collection on existing taxes due to the government.
Ms. Munsod's solutions to increase revenues are credible and should be implemented by the government if they have guts and senses to improve the country's economy.
Manny Villar should not win as President because his frame of mind, although he portrays to have compasion for the poor, is to enrich himself and he does not have a limit to his satisfaction. Following is my matrix for the current aspirants for president and vice president in the coming 2010 elections in the Philippines. Anyone who might be offended by the contents of this matrix, I sincerely apologize as this was not intentional on my part but merely the product of my wandering imagination.
PeteandCel@aol.com 1 Aquino / Roxas I see harmony and peace on this tandem…prosperity of the nation will be slow but steady. Food sufficiency through enhancement of agriculture will be first priority. Tourism, manufacturing and export will get a big boost through cooperation with the public sector. Corruption in the government will totally be eliminated. Peace in Mindanao will be attained through honest and fair dealings with the Muslims. All social services not provided during previous administrations will reach the remotest areas of the archipelago. 2 Gordon / Fernando I see a strong cooperation between this tandem…especially in the areas of environment and social services. There will be a complete realignment in government structures to minimize expenditures. Gordon will not tolerate corruption in government but could still persist in small scale. Food and peace and order will still be a problem although lessened. 3 Villar / Legarda I see employment as the focus of this tandem, so that we will see the encouragement of new industries and entrepreneurs. The exodus of professionals and domestic labor will drop to a trickle and social services will extend to the remotest areas. Food sufficiency and peace in Mindanao will still be a burden. 4 Teodoro / Manzano I see a dynamic activity in this tandem. Both will be working hard to improve the plight of most Filipinos. Peace in Mindanao will be pursued vigorously and corruption in government will slacken. Efforts will be exerted to make agriculture the primary industry in the country. 5 Estrada / Binay I don’t see a lasting harmony between this two. We have seen the performance of Estrada and can not expect much more than pleasing a few poor for only a brief moment. What the destitute Filipinos need is a program that will alleviate their plight for a long long time. We know Binay is an excellent executive as proven by him in Makati. My guess is that Binay cannot dictate on Erap and vice versa, so not much progress can be expected from these two. 6 Madrigal She has good intentions for the country. She is honest, dedicated, competent, and kind to the less fortunate. I really wish she could win, but I can’t see how. 7 Villanueva I love this guy, because like him I also love to read and listen to the words of God. But he is not an evangelist in a true sense. A true evangelist is one who does not live comfortably, lives a simple life, does not accept donations, does not stay long with any group but instead moves around in large circles to convert more people into Christianity. He should follow the example of Jesus Christ who has nothing but the only clothes he wore and the fervent faith in His Father‘s love. Anyway, I do not expect him to win. kagaya rin ng alak at sigarilyo..alam nating lahat na ang mga yan ay delikado sa kalusugan..dahil sa kaylangan ng goverment ang pera ok lang kahit pa alam na masama..at dahilan pa ng maraming namamatay at pinag mumulan ng cancer..
Masama mang sabihin ng goverment na "bahala ka sa buhay mo"kahit mamatay ka..basta may income ang gubyerno.. Ang mga mambabatas dapat din gawing ligal ang huweteng para income narin sa Tax..hindi yung pati tex messaging ay kukuhanan pa ng tax..napaka tagal ng suliranin yan heweteng..pati si Erap nakulong dyan..kaya wala ng dahilan pa para hindi gawing ligal.. I know God has the power, pero may mangyayari ba kung dasal ka na lang ng dasal???? God said..."Kumilos ka at tutulungan kita..." Sa bandang huli, tao pa rin ang kikilos, tao pa rin ang mag bibigay ng hustisya....Kahit di gaanong kagalingan ang Justice System natin, may magagawa pa rin sila at sila lang ang maka pag bibigay ng hustisya na legal... Wag kang aasa na mag ma-magic ang God, porke humiling ka ng justice, ihahapag nya sa harapan mo ang justice.... Wether you like it or not, gobyerno pa rin ang magbibigay ng pataw sa may sala. Kahit na mabagal, kahit na halos lumalabo. Walang magic na mang yayari.... Be realistic..... PAg may justice na nangyari, please don't claim na minagic yon ni God. The reason why i'm writing to you is because that i do not know where else to find help for my brother who had met with an accident last Saturday (November 21st, 2009 @ around 8pm) and currently being admitted at Jose R Reyes Memorial Hospital. He suffered injuries to his face, eyes and legs. His eyes were not in place (Almost coming out) and some of his leg bones were seen broken and coming out from the leg. He is currently 32yrs old with a family of 4 young kids. I had sent e-mails to a lot of people including the house of representative and Department of Health but until now there's no response. Yesterday (November 26th, 2009) was the day he had his eye surgery and that didn't go well. He lost one of his eyesight. This is due to the delay of the doctors providing him the medical treatment or to be more specific the surgery. He was admitted on November 22nd @ around 3a.m at that Hospital after being rejected earlier by the hospital staff due to the reason of the hospital has no more room for patient. The doctors left him lying on the bed while waiting for us to come up with the money. They asked for Pesos80,000 but increase it right before the surgery to Pesos95,000. Now, after the surgery the doctors are asking for more than Pesos160,000!!!. Don't they supposed to know the cost before they inform it to us??? If im an automobile part dealer, i should know how much is the cost and how much i supposed to sell the parts to the car workshops!. And all these is only for the eyes. How about the legs??? Jose R Reyes Memorial Hospital is acting like a private hospital!!! The funny thing was the doctor asked my family why was he not treated earlier!!! He was there in the ward sinced November 22nd and any doctor who was supposed to treat him should know his conditions very well. They even mentioned that my brother may go blind should the surgery being delayed but they delayed it anyway because they wanted to have the money first before doing anything. I could understand if this is a private hospital but its not!!! It is a goverment hospital registered under The Department of Health. To say that the doctors know nothing is unacceptable. When my brother was rejected at Sapang Palay Hospital, East Avenue Hospital, Jose R Reyes Memorial Hospital , Orthopedics Hospital and then back to Jose Reyes Memorial Hospital, wasn't there any report of his medical condition or any treatment done onto him from any of those hospital before he was admitted??? I did a little bit of homework and found out of the ruling made during President Fidel Ramos (Republic Act 8344) which clearly stated that in case of an emergency, no medical practitioner shall demand money before giving necessary treatment to the patient. Especially those cases which may cause death or permanent disability. I believe in my brother's case, because of the delay and greediness, he has suffer permanent disability. He lost one of his eyesight permanently! Me and my family are poor people and we have been requesting assistance from a lot of parties. We even pawned our house and sell everything to generate those money. I am pleading to you or any body else for that matter to assist us wherever you can in order for my brother to get his proper treatment. The first hospital he went at Sapang Palay rejected him due to insufficient equipment, the 2nd hospital, East Avenue also rejected due to the complication, the 3rd hospital was Jose Reyes Memorial and they too rejected him due to "our place was full" reason and referred him to another hospital they called "Orthopedic". Bad luck again. He was rejected and was sent back to Jose Reyes which after a lot of hassle and quarreling agreed to admit him. That was at about 3a.m in the morning. My brother in lost a lot of blood and was made to tour the city to find a hospital which can accept him...Poor him. After diagnosing, the management of the hospital demanded that we pay for the "so much needed" eye operation but was left unattended until the time i write this e-mail. They needed us to provide Pesos80,000 before they can start anything. I have read the Republic Act 8344 on health that explains clearly that a patient with that such a bad injury should be given treatment immediately before anything else. The way the hospitals in Manila are behaving is against the ruling made during the time of Fidel V Ramos. My brother was made to suffer just to be admitted and has yet to be treated properly.
