Did you notice the so-called clamor to revisit the Oil Deregulation Law follows a cyclical pattern. It gets very loud at a time of rising international oil prices, and dies down when these prices decrease.
So let us try to put to rest once and for all the issues that have to do with oil prices, such as: is there a cartel in the Philippine oil industry? Are the prices charged by these companies higher than what they should be charging, or higher than the prices that would have been charged under a regulated regime? Are the oil companies making excess or monopoly profits? Actually, these questions were addressed as early as 2005 (when oil prices were rising, and the clamor was loud) by an Independent Review Commission formed by the Department of Energy and headed by former SGV head Carlos Alindada, with members from the labor sector, transport sector, private sector, academic sector, and the petroleum dealers association. Their study was updated in 2008, with the commission being headed by Peter Lee of the University of Asia and the Pacific. Let's look at these issues one by one. First, about cartels. A cartel is a combination of firms or nations designed to limit competition or fix prices. There is a cartel in the oil industry, the cartel known as the Organization of Petroleum Exporting Countries or OPEC, who try to influence prices by setting production quotas, thus influencing the supply side of the international oil market but a cartel in the Philippines is another matter altogether. The Alindada commission found no evidence of a price cartel. Then why are the prices of the three oil companies very close, if not identical, to each other, one may ask. The answer is quite simple: in the same way that the prices of firms operating under conditions of pure competition are the same, the oil companies cannot afford to have prices very different from each other. If one firm's prices are higher than the others, it starts to lose market share, and therefore has to move its prices back down in order to survive. But the point is thanks to oil deregulation law even if the Big 3 oil companies in the Philippines wanted to conspire to set prices, they will not succeed – because the moment their prices are out of line with international oil prices plus transport cost to bring to the Philippines, the smaller firms (there are now about 80 of them in the industry) will jump at the opportunity to import the petroleum products and undersell the Big 3. In other words, while the Big 3 oil companies account for about 90 percent of the Philippine market, that market is contestable – because the Oil Deregulation Law, which made the entry of the 80 firms possible in the first place, also allows the importation of petroleum products –ready to compete with the Big 3. Which brings us to the second question: Are the prices being charged by the Big 3 higher than they should be? The National Economic and Development Authority or NEDA presented a paper that asserted that based on historical data from February 2005, and interpolating it to the present, there may be a P6.00-P8.00 per liter overprice as of April 2009. But it turns out that its assumptions were too stringent – failing to take into account of other factors. Apparently the introduction of bio-fuels adds something like P1.00 per liter to the pump price of gasoline, and the use of double-hull ships adds another peso. Plus, pump prices used in the base year were reflecting the international crude oil prices of the previous month, rather than the current month. By the way, according to the DOE, Philippine pump prices are cheaper than most Asian countries who are also importing oil. Go figure. And again, the final test: if the big oil companies were overpricing, the smaller players would have had a field day bringing in imports, underselling the big players, and making huge profits. This did not happen. It is not deregulation that has caused the price increases, but the increases in the international crude oil prices, as well as currency depreciation. And finally, aren’t the large profits of the oil companies an indication that they are charging excessive prices? Well, “large” is a relative thing. Put it this way: If a company had profits of P500 million, that sounds like enormous profits. But if you factor in the information that the company's equity, or its “puhunan,” was P50 billion, that changes the picture entirely. Because now you find that the rate of return on equity is only 1 percent –which means that if the company had just put its money in the bank, it could have earned much more than that. It turns out that, and this according to the Independent Review Commissions, between 1998 and 2008, the oil companies made average returns 5 percent on equity. Bottom line: there is no basis for the suspicion of cartels, overpricing, and excess profits. If anything, deregulation and making the Philippine oil market contestable, seems to be working. I agree with Mareng Winnie, but I have to comment that it is not the small players that are keeping prices down, but also because of fuel smuggling. Taxes account for 15% of diesel cost, and at least 30% for gasoline. Those who smuggle diesel and gasoline do not have to pay these taxes, and can compete with any oil players in the market...

JUST BECAUSE OF THE SHIPMENT, WELL 4 TO 6 PESOS DIFFERENCE IS TO BIG, THE GOVERNMENT SHOULD LOOK INTO THIS MANIPULATION OF THIS GASOLINE PRICES GOING TO THE PROVINCES. Kahit ang US na producer din ng langis, kung titingnan mo ang prices nila, medyo pumapantay pa rin tayo o di kaya mas mababa pa. Nababasa mo rin naman sa international news, pabago-bago ang pricing ng langis sa buong mundo.
Bakit tayo kasi konting bagay lang pinapalaki. Kasi ito ring mga Bayan Muna, Anakpawis, etc... iniexaggerate ang mga issues. Meron sa atin talaga mga Chronic Complainers. Laging galit sa mundo! Yung pananaw mo na mas mura pa ang presyo ng langis sa pilipinas kaysa sa US ay "relative" yan. depende kung papaano mo ma perceive ang sitwasyun.
Halimbawa: Let's say ang presyo ng langis sa pilipinas ay pantay o equal sa presyo ng langis ng US. That would make two (2) different assumptions from the statement above. Assumption 1 is kahit na kapareho ng presyo pero mas mura pa rin ang pilipinas dahil kumpare mo sa US na dollars ang ginagasto ng mga tao o dapat mas mahal ang kanilang mga bilihin. (ito ang iyung pananaw sa blog mo pasternak) O pwede rin ang assumption 2 : Na kahit magkapareho ang presyo ng langis ng pilipinas at US pero medyo may kamahalan pa rin yung presyo ng langis sa pilipinas kasi DAPAT ay mas mura sana ang presyo ng langis sa pilipinas dahil mga bilihin ay mura naman sa bayan natin pati ang sweldo. So depende yan sa pananaw ng tao kung mag sasabing mas mura ang langis sa pilipinas o US, in other words, relative ika nga. Ito pa isang halimbawa pasternak kung bakit ko nasabi na kahit magpakapareho ang presyo pa ng langis sa Pilipinas at US ay pu-pwede pa rin nating masabi na medyo may kamahalan ang langis sa pilipinas.
Example: Yung isang truck driver ng langis sa US ay magsasahod ng average of 5000-6000 dollars kada buwan o mahigit 300,000 pesos kada buwan. Samantalang ang isang pinoy truck driver ng langis sa pilipinas ay magsasahod lang ng 8,000 to 10,000 pesos. So sabihin man nating pareho ang presyo ng langis. eh di halata pa ring mas malaki ang kita ng mga OIL companies sa pilipinas kaysa dun sa US kasi sa deperensya ng SAHOD ng mga workers nila ay napakalaki! and take note, isang truck driver lang ang kinumpara natin. Hindi pa kasali ang sahod ng iba pang empleyado sa OIL companies ng US at ng pilipinas. Ilang milyun kaya ang deperensya sa kabuaang sweldo ng isang kumpanya ng langis sa US at ng pilipinas kada buwan? Kaya base sa mga sahod ng tauhan ng oil companies sa US at sa pilipinas then masasabi natin na medyo may kamahalan ang presyo ng langis sa pilipinas kahit na pareho lang sila ng presyo sa US. Na-check mo na ba kung magkano presyo ng langis sa US? Na-tsek mo rin ba ang presyuhan sa ibang ASEAN countries? Kasi kung ikumpara mo di hamak na mas-mababa sa Pinas. Sa US aabot ng mahigit 60 pesos ang gasolina,to think na producer yan ng langis. At binasa mo ba ang blog ni Mareng Winnie? Di hamak na mas mababa ang presyo ng langis sa Pinas kesa sa karamihan ng Asian countries. Kung sa tingin mo mas matibay ang data mo, ilatag mo dito, wag yung sa US ka lang nakatutok. Ang presyo ng regular unleaded gas dito sa US ay average ng $2.4 dollars per galloon. Ngayon one galloon is equivalent to 3.785 liters. Sabihin nating isang dolyar is equal to 48 pesos. Now you do the math... that means dito sa US ay nagbabayad lang kami ng 30 pesos kada litro ng gasolina. Magkano ba sa pilipinas ang isang litro? hindi ba mahigit 47 pesos? Eh di mas mahal ang presyo ng gas sa pinas kaysa US. Thinking ang sahod ng isang truck driver ng OIL sa pinas is only 8000 pesos habang dito sa US ay 350,000 pesos kada buwan. Mas malaki pa ang kita ng OIL companies sa pinas, mahal na nga yung gasolina eh mura pa ang sahod sa mga tao na nagtatrabaho sa OIL companies sa pilipinas. Mas mura pa rin dito sa US ang gas.

Ikaw ang bobo, tanggap mo na nga e! Ok, understood na mas mura diyan kasi nga isa sa mga producers ng langis ang US. Sa Saudi nga, 90 cents lang ang litro, o less than 10 pesos.
Bakit sa US ka lang nakafocus? Ang sabi nga sa blog ni Mareng Winnie kung icompare mo sa most of the Asian countries, mas mababa pa rin sa Pinas. Ayaw niyo lang kasing tanggapin ang katotohanan. Dahil isa ka sa mga gullible viewers ng TV na kung yan ang sabi ng mga raliyista, naniniwala ka agad, uto-uto! Dapat sa mga oil-consuming countries ka tumingin para makita mo ang buong gubat, hindi ang isang puno ng gubat. Nasa US ka nga, ugaling squatter ka naman!!! The local refineries are not cartels, they have to answer to the big ones. Opec the source of the oil and the producers like British petroleum, Chevron, Shell, this are the worlds cartel. They dictate the price of the world's thirst to burn fossil fuel that cause global warming.
We had the Bataan Nuclear Power plant why can't the government spruce it up and operate it and build more Nuclear plant throughout the country. The government should fund a research for alternative fuels We are surrounded by ocean, plenty of sun and winds. price of oil is the manipulator of all other commodities.

Sagana lang sa tubig ulan at baha ang pinas kaya hindi nila pinapahalagahan ang importansya ng malaking grasyang ibinibigay ng Diyos sa kanila,bagkus ikinaiinis pa ng iba. There is no cartel mare, it is just unfortunate that all the oil players are greedy to the max.
Oil cartel is not merely about price control but about market protection. You will not see much difference in price because the big 3 have similar base cost, but note that if you use say HHI anti-trust standards, their market influence invariable leads to establishment of cartel. Moreso, there is info that they are borrowing inventory from each other. Ostensibly, they protect each others' market share and are contented with the current 90/10 market. The price analysis is skewed in many instances but if one curtail their market influence, oil price will go down to such level that everyone will benefit. The price differential between them will still be insignificant, but pricing will be in the lower end of the spectrum in general.
I like mareng winnie but this time, i sounds like her husband is the one who writes this article. Christian is one of the directors of a big oil company.

Although things you have said are true, I still believe that the prices are controlled by these oil companies. One could say that prices are similar to neighboring countries, but it is very noticeable the way they control the price increases and reductions. Kapag tumaas ang crude oil sa world market, isa o dalawang araw pa lang price increase na sila, at malaki pa ang increase. Kapag bumaba naman ang crude oil sa market, linggo ang bibilangin before it starts to go down, if not, trickles lamang ang price drop. Before it even goes down to the price that it should, tataas na naman ang world market and so no reason to bring it down anymore. Maybe we can expound on these aspects. I understand about the logic of the ever changing oil price. But what I don't understand is the big discrepancy of the gasoline and diesel prices in Cebu to other big cities in the Philippines. How come that GMA and other big cities in Mindanao have a much lower prices compared to Cebu? Due to the law of supply and demand? I doubt it. We all know that GMA has more cars compared to Cebu and Mindanao has lesser cars compared to Cebu. Due to transport expense? Cebu is nearer to GMA than Mindanao. Can you explain that Prof. Monsod?
Oil vs water
Kung gugustuhin ng pinoy na gamitin ang tubig sa mga sasakyan ay pwedeng pwede.di ba si marcos pa nga ang nagtest drive nuon at pinakita pa sa t.v. Pero kung may gagawa uli nito ay isa lang masasabi ko,magtago na sya at tepok sya. Subukan mong banggain ang OPEC,kahit ilang milyon ay kaya nilang magbayad para lang iligpit ka dahil isipin mo ang maapektuhan nito.ilang bansa ang babagsak bigla.ilang milyong tao ang nagtatrabaho sa mga oil co. ang mawawalan ng trabaho. But the fact of the matter,there are lots and lots of energy sources.some are free and some needs a little bit of fine tuning of technology. Imagine what will be the world if you suddenly stop oil usage...WAR and CHAOS it is the world leaders responsibility to find alternative ways in having available transportation that doesn´t depends much in fossil oils.
OPEC can used their oils for a much useful projects like for a spaceships,or something that really need the oil to run the said engines as fast as it can,but not to be use for automobiles just to keeps them employed. At ang OPEC magconcentrate na lang sila sa ibang proyektong hindi makakaapekto sa kalusugan ng tao. Why not regularly monitor fuel pump prices in key Asian cities? If our fuel prices move up in time - cartel, otherwise, we all shut up and go to work. Simple and accurate.
Same thing with Presidents: What was Philippine GDP rank when say Marcos left compared to when he first came in. His score would be (2 minus whatever that very high number is). Simple and accurate. Generally, we waste too much time and energy ranting emotionally with no sound quantitative basis whatsoever. Thank God we have the likes of Prof. Winnie Monsod. Then let their money put in the bank, who cares? The govt. job is to serve the people and that's include to give lower price in oil to pump up the local economy. the govt. is not made just to set in the chair and let the chinese traitor businessmen distribute the oil. oil is a vital part of every nation and this should be handle by the govt. Govt. should build more oil depot that could sustain 1 year more of nation consumption.
because if govt. will snub this sector then our nation will be cripple down in a day such in the case of "oil shock in 1970's" more depot also could protect the nation from volatile oil price in the world market. The problem with us, is we are just only a small minded race. our thinking is not one move ahead. are you not wondering that why the white piece is always advantage than the black piece in the game of chess? because the white piece is one move ahead. how about if our thinking is 2 to 3 moves ahead? then that time we control the world and dumb those chinese inferior race! build more depot in luzvismin and interconnect it with oil pipelines
build stategic oil refinery for Luzvismin. building oil depot and refinery is like building roads, flyover and etc., it is vital for strategic growth of the country. congress pork barrel will be suspended to realized that dream. but unfortunately if that thing will push through there will be no congress man left in the house of congress. Oil deregulation law is working well!
kaya kung ako, imbes na makipagbunuan tayo sa mga Big 3 Oil companies, pag-aralan natin paano madevelop ang biodiesel para mabasawan ang dependence natin sa langis. Ang langis ang pangunahing dahilan ng pagtaas ng bilihin sa atin.. kung mura ang langis sa atin bakit hindi makontrol ang pagtaas ng bilihin..laging dinadahilan ng mga producers ng pagkain ang pagtaas ng langis..
Ok kung mababa ang langis sana naman pati pagkain ay bumaba din..ang kaso pag bumaba ang langis hindi bumababa ang mga bilihin.. Sa mga may sasakyan na gumagamit ng gasoline at mga makina..qok lang yan pero sa mga walang "car" na nakaka dami..
