It is sad that DOJ Secretary Leila de Lima is being perceived as a ‘purveyor’ of a weird and dangerous legal thinking. In the first place she is NO ordinary person but the Secretary of Justice, no less. The Secretary of Justice is the FIRST person to uphold the Rule of Law that is the very foundation of our justice system.
The whole crisis began with her assertion that DOJ Circular 41 that authorizes her to put people on the so-called ‘watch order list’ results also to a de facto ‘hold order’ list that impinges on the citizens’ constitutional right of freedom of movement guaranteed by Section 6 of the 1987 Constitution’s Bill of Rights. TV commentator, Teddy Boy Locsin, has said it very cogently in his TV editorial that DOJ’s directive is simply a watch order list and ‘WATCH and ‘LIST” it can do as long as DOJ desires so. But to prevent people to travel or to impinge on the Constitutional Right to free movement is NOT DOJ’s competence or power. That power belongs to the court and the court can only do so on the basis of three specific provisions of the Constitutions – (a.) threat to national security; (b.) public safety; and (c.) public health; (d.) as may be provided by law. For Teddy Boy Locsin, Rep. Gloria Arroyo or any citizen for that matter, whether appearing in the so called watch over list or not NEED NO permission from government to travel! They simply go and travel and if so detained by government should sue government for the violation of their constitutional rights. In a similar vein, foremost Constitutionalist, Fr. Joaquin Bernas, SJ, concludes in his Inquirer piece, Puzzling Circular, that DOJ Circular Order 41 “is humorous were it not for the fact that it plays around with an important constitutional right”. The Supreme Court ‘clearly states that ‘hold departure order’ shall be issued ONLY in criminal cases within the exclusive jurisdiction of the regional Trial Courts.” He says that DOJ ‘by an act of supreme creativity authorizes itself’ to do so on the basis of a ‘whereas clause’ where the SC is silent with ‘respect to cases falling within the jurisdiction of courts below the RTC as well as those pending determination by government prosecution offices’. The whole issue has reached the apex of ‘absurdity’ by pitting the Supreme Court and the DOJ Secretary de Lima with the issuance of TRO of the Supreme Court granting relief to the petition to travel by Rep. Gloria Arroyo and the former first gentleman. Notwithstanding the SC’s TRO, DOJ Secretary de Lima in a ‘weird and dangerous legal logic’ has chosen to defy the SC’s TRO. The first basis, she claimed was the fact that the DOJ ‘had not received’ the TOR and the same office was ready to file a Motion for Reconsideration and until the SC acted on the MR, the hold order for the travel of Rep. Arroyo and the former first gentleman stay. The SC spokesman in repeated interviews has, constantly, said that the Supreme Court has already spoken and granted relief to the petition of the former first couple. All government offices have to comply with the Court order or face a direct contempt of the court. All legal luminaries are in the same view that the TRO is effective upon the issuance by the SC and NOT by the receipt of DOJ, especially when the mass media organizations already had copies of the said TRO. If DOJ Secretary is committed to the Rule of Law, especially when all media people already cite the said TRO, she should have restrained herself and complied. But if she has NO intention of complying, she can invent all reasons not do so. The real issue here is compliance or non-compliance with the rule of law and NOT some legalese thinking bordering to putting oneself above the Supreme Court. When it comes to Constitutional Rights or Rule of Law, the matter is not resolved by popular feelings or sentiments. The way Secretary de Lima is acting and behaving, I can only surmise that she is not only being stubborn but also being ‘arrogant’ in her display of power. This behavior is, definitely, NOT in accordance with PNoy’s avowed ‘matuwid na daan’. The way she is going about the whole case, she appears as the ‘epitome of vindictiveness’. The Supreme Court should nip in the bud, ASAP, this de Lima doctrine that is truly a weird and dangerous legal thinking, else we put our constitutional rights in ‘clear and present danger’! Parang laban lang ni Pacquiao yan kay Marquez, nirespeto natin ang hatol ng judges kaya respetuhin rin natin ang hatol ng Supreme Court. HAHAHA
there is no other way. If Filipinos no longer respect the Supreme Court, or any court of law, we do not only have a judicial crisis. It will also be a serious political crisis that threatens the security of the state.
No one is above the law. That applies to Supreme Court justices if you have proof they have been bias or they abused their authority. Why Blame De Lima alone? Why not blame her boss who gave the order?

Rule of law? But which should prevail the spirit of the law or technicality. Besides, the rule of law presumes that everyone are equal before the law. And we all know that it is not so.
Also, if Sec. de Lima is accused of arrogating unto DOJ a power that is not it, why in the first place the DOJ Circular 41 was allowed to be promulgated by GMA(it should have met with massive protest) and used to curtail the right of travel of others including her political enemies. If the DOJ circular is voided, what happened now to those who were restrained to travel on the basis of the DOJ circular.Should they be compensated. Should Arroyo be made to account to use an illegal circular to contained her political enemy.To me all these talks of rule of law under current circumstance is purely an academic discussion premised on an ideal world. Sec. De Lima is not arrogant she just happened to be smarter than those 8 judges sitting in the SC.What a coincedence that those 8 judges happened to be appointed by arroyo. I aggree, GMA has constitutional right to travel, however, she is thically, lawfully, and morally bound to face and answer serious allegations against her. She should be barred to travel.
The Rule of Law is important...Just as important, , the Enforcement of Law. We must follow the Law, and then let Law take its course. Or else we become a nation of accusers, hysteria, and unsubstatiated accusations.

In fact, the majority of the judges are voting along political lines and curtailed due process so that Arroyo can leave the country and escape from the claws of the law. In this case, if the fictive Rule of Law prevails the Filipino people will be deprived of justice. We should put the citizens' interest at the center of this debate over the Rule of Law and the Need for Justice. the problem here is not GMA. I hate her as well for she had done in this country. However, the issue here is the way the law is being mocked upon by the DOJ. There are only two possible scenario here, first, we go back to the time of the wild, wild west. When people do not follow the law and even have to carry their own guns. Or we can establish a kangaroo court so that we just forget alla bout the laws in this country. Dissolve the legislative branch of the government in as much as no one will obey the law anyway if we have to follow what DOJ had done. I understand the emotion and anger of each of us but it does not give us the right to break the law. Otherwise we become uncivilized. We shall be in the same level of the person we hate so much. it is pathetic.

iingay niyo What use is the law if true justice is not served? SC cannot be trusted with their decisions (TRO). Delima was doing her job to serve justice to the Arroyos. In this country where justice is usually favored to the rich, it is sweet to see justice being served to the former president who has been known to have cheated the elections and amassed wealth through corruption.

The whole charge against PGMA is based on the testimony of Norie Unas who became a state witness against PGMA... He is also one of the primary accused in the Maguindanao Massacre. He now goes 'scotch free' and given full protection by the state plus full financial support... WOW na wow! Norie Unas with Lintang Bedol were the principal manipulators of the now so called election sabotage during the 2007 elections. Free na siya sa massacre, free pa rin siya sa election sabotage... okay lang sa DOJ and COMELEC basta makulong si PGMA... Nang nilagdaan ang TRO effective na yon. Receipt ibang estorya naman yan. Nang prenisenta and TRO sa NAIA it is deemed received by DOJ which is the author of the hold order. Isang dial sa telepono lang yon sa secretary kung hindi alam ng NAIA ang gagawin.
Na hindi nakita ni Sec de Lima hindi valid reason yan sapagkat ang isang organisasyon ay may chain of command. Halimbawa hindi puede i-delay ang isang tao sapagkat natutulog o nag bakasyon ang Secretary. Meron siyang deputies. Justices- Hurriedly issuing the TRO without hearing oral argument. They should at least immediately set the oral argument before issuing TRO on the logic that the TRO applied have both consequential or irreparable damage to both party. GMA medical condition as per her doctor is not life threatening, the immediate need to travel can be ruled out they can at least wait for more days. GMA & Party- Having the SC on their side chalenge the government by hurriedly trying to leave hours after the TRO have been issued. Whatever intention they have Im sure the lack of trust by people continues to over shadow whatever their reasons are. PNoy-DOJ-De Lima- Have to arrogantly show that they are in control and openly defy the TRO on the grounds that they know that the public wanted which to to held GMA accountable for their crime. Weighing the consequences, pleasing the public who wanted to see GMA & party in jail vs. abiding to the TRO with possibility to lost control of the case and fails its commitment to the public. i think De lima is lack of sex activities kaya masyadong mainiti ang ulo.. in other words kulang lang yan sa jerjer..
Because Circular 41 is not unconstitutional. What is unconstitutional is the DOJ secretary defying the ruling of SC. What is unconstitutional is preventing somebody to leave thru implementation of a watch list. A hold departure order can prevent the Arroyo's from leaving and not the watch list.

The SC spokesman in repeated interviews has, constantly, said that the Supreme Court has already spoken and granted relief to the petition of the former first couple. All government offices have to comply with the Court order or face a direct contempt of the court. Really????? and what if SC spokesman was wrong in interpreting the SC ruling? what if the pre-requisites of the TRO was not met? as it is... Common-sense really is not common...

I admired de lima's boldness to circumvent the incident. She knows well the consequence of his actions, and still made the decision for the greater good. Only few government officials do that this days. Mostly they are just pencil pushers and finding more ways to cheat the government of it's money. Today, we celebrate the first Sunday of Advent and I cannot help but ask the question why there is so much 'mob lynching' of the former President Gloria Macapagal Arroyo? No doubt, if we go by the continuous barrage of text surveys, there is a public demand for 'blood' and PGMA has been demonized as if she were the personification of evil. I am a friend of PGMA for many years since she first became public servant as a Trade Undersecretary under President Cory. It is a friendship that has known ups and downs depending on the vagaries of politics, especially in the last years of her presidency. I am no stranger to her virtues as wells as sins, yet I can always stand as her friend, especially in times of needs and sickness. It is a friendship that goes beyond the vagaries of politics which in practical terms have been translated as 'weather weather lang'. I am a strong believer of justice and the rule of law and for this reason, I uphold that indeed if PGMA has committed any wrong during her nine years as President of the Republic, let the issues or cases be PROPERLY filed in Court and not in public forum for mob lynching. I visited her in the hospital last Thursday to honor a sick friend remembering that when I was similarly confined in the hospital after my open heart surgery in 2002, she was the first visitor I had after I was released from ICU. And during my visit, she fondly remembered that the first Muslim Cabinet member she had upon assumption the Presidency was due to my text message. This she also acknowledged publicly during her first Presidential visit to ARMM. She also told me that never in her nine years as President was a Muslim was lacking in her official family. I cannot overlook the fact that I had the special 'privileged' of having 'mutual contact' on Mindanao Affairs and on the peace process by text messages until we parted ways when I joined the former President Cory Aquino to ask for her resignation post the nbn scams. PGMA as President could be characterized as a worker, at times, bordering to being a 'workaholic'. She had the discipline and the stamina to sit, read and act with determination what she believed to be good for the country, with a special concern for Mindanao. She was, definitely, grounded and focussed! In nine years as President of the Republic, her administration was also equally characterized by scams that led to coup attempts, impeachment attempts, and call for resignation. In short, she has almost equal share of successes and scams. Yet, I believe that to resolve all these controversies we should be guided by our high ethical standard and rule of law NOT by any tinge of vindictiveness and definitely NOT by mob lynching albeit it seems popular! I am not ashamed to visit her in her sick bed... and I am not embarrassed to say that I have brought her some joy in times when she feels she is all alone seemingly abandoned and feeling being the victim of government's fixation to bring her to prison before Christmas at all cost. I also believe that government has bigger concerns and much bigger agenda other than PGMA's travel to seek medical assistance. And definitely, I feel that it is a tragedy if PGMA from the looks of media coverage and debates has become seemingly the main and only agenda of government. I thought when Justice Conchita Carpio Morales has been appointed as 'Ombudsman', the prosecution of wrongdoing now belongs to her jurisdiction and government can attend to more important things other than PGMA! Moreover, though we are a Republican government where all are equal before the law, yet by tradition and culture I too subscribe both in spirit and praxis to the French maxim: 'noblesse oblige'. Former President of the Republic like our elders command that 'noblesse oblige' - perhaps no longer on basis of royalty and blood but on the basis of the good work done. We remember not only the bad deeds but also the good ones, specially in times of sickness and needs. In fact, even in times of war, sickness demands magnanimity of spirit and on this basis, sanctuary and truce are, often, declared even among mortal enemies and combatants. I am truly saddened that people are being goaded to leer for mob lynching of PGMA even in times of sickness and definitely I see this as wanting in magnanimity of spirit. I have observed this with trepidation and I have asked myself where all these cruelties are coming from... I have seen many battles fought in Mindanao and so much casualties and victims. Yet I have always examined myself if I have been wanting in remembering our tradition as well as our magnanimity as a people? Fate is nothing but faith. We can assume, however, that you are not aware or simply refused to see. Whatever the reason maybe our sad stories remain and are killing the most innocent of us. Familiar with the twelve year old girl who committed suicide? She resigned to death thinking that no matter what her family does same thing will happen. She resigned her fate to death believing that life betrayed her remaining hope of beating the odds that have consumed her family for years. A sad story indeed. Some sympathized. It was highlighted for weeks. Media pledged support for her family. It was big news then but months later, well, same with other sad news it faded in our memory. Relegated as just an isolated case. Surely, it will not be part of history. What is interesting, however, is every time we hear story like this we always go back to the basic question – “where did we go wrong?”, and persistently asked the same question as if we are driven by a conscience strong enough to drive the individual hidden desire to collective action capable of breaking the base of the seemingly perpetual historical maladies. Every time we ask the said question, we always say – it is because of our superficial self reflection and parochial attitude to politics. But after that what happen? Well, no need ridicule oneself by citing the obvious pathetic limit of our analysis. Participation, same with other elements of change, was reduced to sigh of hate to oneself. There are those, however, who claim to be guided by generativity but their actions point to the contrary. They may or may not be aware of it. They will use innocence, ignorance or even good faith as an excuse, such, however, are lame excuse to hide the real meaning of their actions - connivance to those in power, to whom the privilege of structuring political values are given. If smile could reveal the blood thirst glutton within, pretensions would be transparent as tears of an innocent child that weeps for the lost opportunity for redemption. Your psyche has become so indolent it failed to identify the natural moral law that had been guiding human actions to what is good and proper. In Philippine context it seems to be just thing of the past. Pretensions to knowledge rended sanity from initiative, hope from dynamism, and common sense from sensitivity. Good faith is reduced to mental construct so viscous it paralyzed memory, realism, and initiative to inaction. Tell me Father...are you guided by generativity? true friends are people that will stay at yourside in good as well as in bad times. gloria wasn´t proven guilty yet of the crimes she was accused of,so why on earth pnoy gov´t and the public already treated gloria like she is guilty of those charges filed against her. everyone considered innocent until proven guilty,if pnoy no longer trust the supreme court because most of them are gloria´s appointtee then let pnoy establish his own supreme court approved by the people. erap,fpj,lacson are some of gloria´s political victims and for that they join together to punish gloria now that she is no longer the president,as what erap says"pana-panahon lang yan" so after pnoy is no longer in office it will be gloria´s camp turns to put pnoy in nasty fates as political history of this country evolves only in lies,vengeance and corruptions. Obama would never want to do such nasty moves against the crocodiles politicians of US,for he knows they are not that easy targets,they will revenges for the worst scenario he would not want to even imagine. gloria did hurts her political opponents but she did makes her allies enjoy a glamorous life during her administration,the same with other past presidents those who are more closers to the leader are not hungry while those playing villain suffered in vain. is it wrong to be friend with anyone in trouble? what if a scenario like what gloria face today happen to you or to pnoy would you be happy with out having one friend to stand for your rights as a person not as formerleader or whatsoever. lets see if gloria is really guilty of the charges against her and if she is found guilty due of authentic evidence and credible witnesses then let her face the punishment she deserves but now don´t force friends of gloria to join the camps of erap,fpj,lacson who are still sour gripping over their embarassing moment during gloria´s term. i think gloria needs not to show the public she is worried of anything she is accused of,after all she is not the sole perpetrator of the crimes if that is a crime to cheated in the election when infact that´s been the practices of the past politicians eversince the so called election was establish. media make it a big news so that pnoy could pretend he is tough enough to catch the crocodiles under his mandates but he alone could never had the balls to pin down the arroyos knowing they are not that easy to defeat. see what happen to fm vs ninoy case up to now the aquinos are still not fully satisfied to whatever justice they acquired under cory´s and ramos term. the one will benefits from that issue are the lawyers for they are the ones could earns billions if not trillions pesos from the said judicials debates,hearings and tactics...its all about money,mockery and injustices that plays the game. the filipino people will remain poor even all crocodiles are jailed because the GDP of this country not even enough to feed the prisoners...sad but true. nagsama-sama ang mga kaaway ni gloria sa politika sa pangunguna ni pnoy,erap,lacson,kampo ng pumanaw na si fpj,at ang mga magdalo na kahit ipinakulong sila ni gloria noon ay nakabuti naman sa kandidatura ni trillianes dahil napunta sa kanya ang simpatiya ng mga pilipinong madaling makuha sa paapi effect.
sa totoo lang kaya lang naman si pnoy nanalo dahil sya lang ang kandidatong nanindigan paparusahan ang mga kurap oras na sya ang maging lider. ang tanong hindi rin naman ni pnoy kayang patunayan na kurap si gloria dahil marami ang nakinabang sa kurapsyon ginawa ni gloria lalong-lalo na ang mga politikos na kaalyado ni gloria,ang cbcp,comelec,doj,ombudsman,ang militar,ang kapulisan,ang mga hukom,dpwh atbp sangay ng gobyerno. kaya paano pananagutin ang kurap na lider kung ang makakalaban ay sangkaterbang mga malalaking buwaya. paghindi na si pnoy ang lider,hindi ba sya natatakot na sya naman ang akusahan ng kung anu-anong mga anomalya ng sa gayon mapahiya rin sya? if i were pnoy i would concentrates in producing more pesos,jobs,foods,medicines,educations,right information towards family planning that needed badly by filipino people. this issue about gloria will not help alleviate the poor,the only people will benefits from it are the media,the politicians,the lawyers and the judges but the poor will still die hungry because they has no jobs,no money,no house,no foods. kung walang kurap,walang mahirap bakit marami pa rin mahirap,ibig sabihin marami pa rin ang kurap sa ilalim ng pamumuno ni pnoy. kung walang tamad,walang magugutom yan ang tamang slogan kaya dapat ang gawin na lang ng lider maglikha ng maraming trabaho para lahat may trabaho walang magugutom kaya wala ng magsasabing sila ay mahirap dahil kung mayron man sila ang mga taong tamad. ang katamaran kapatid ng kagutuman kung lahat maytrabaho lahat may kakainin. Bakit matatakot si PNOY kung malinis ang record niya. Walang kurap at pagnanakaw na gagawin. Si Gloria sang katerba ang kurakutan at nakawan . lahat ng tuta niya nagnakaw.. kawawa ang taumbayan sa panloloko nila .
kahit malinis ang record ni pnoy at wala syang ginagawang masama kung makagawa ng paraan ang kampo ni gloria na matukso sya para gumawa ng mga maling hakbang tyak sa kahihiyan rin ang bagsak nya.
nong mapatalsik si erap at iluklok si gloria akala ng taumbayan matino ang pumalit kay erap walang bisyo at anak ng dating lider ng pinas pero dahil kung anu-anong mga kontrobersya ang pilit idinadawit sya kaya syimpre marami ang magagalit at mamumuhi kay gloria. hindi natin alam kung ang nagsulsol kay pnoy na bumili ng porche ay pakana rin ng isa sa mga nakalaban ni pnoy sa politika para hanapan sya ng ikapipintas sa kanya at ng naglabasan na nga noon ang juanachanges sa balita na nag-akusa kay pnoy na maluho at walang simpatiya sa mahihirap dahil kung makamahirap sya bakit sya bumili ng porche gayun alam naman nya maraming walang makain na pilipino kaya ayon para makaiwas sa kritisismo ibinenta na lang ang porche para matapos na ang pambabatikos sa kanya. kaya ngayon maingat na maingat si pnoy sa pagbitiw ng mga desisyon dahil kahit inaakala nya para sa kabutihan ng lahat ang ginagawa nya ay may mga tao pa rin syang masasaktan ang damdamin dahil kahit masasama ang mga taong inaakala nya ay mga tiwaling opisyal pero may mga taong hikahos rin naman silang natulungan at nadamayan kaya kahit masama sila sa paningin ng iba para sa mga natulungan ni gloria sya ay bayani nila kaya tama ang kasabihan,you can´t please everybody. paano naging kawawa ang taumbayan kung mismo taumbayan ay naglolokohan,hindi lang politiko ang mga manloloko kahit nga bata alam na rin kung paano uutuhin ang kanilang magulang. mahirap mabuhay sa planetang ito kung kahalubilo mo ay pulos mga demonyo,hindi ka nila tatantanan hangga´t hindi ka nagiging demonyo rin. kaya siguro pinili na lang ni Hesus Kristo ang bumalik sa langit keysa makisalamuha sa mga makasalanan nilalang na walang alam gawin kundi kademonyohan. pag-ikinulong ni pnoy si gloria baka humingi ng tulong si gloria sa tsina o kaya sa europa at ipaataki ang palasyo para makalaya sya sa kamay ni pnoy. tiyak tuwang-tuwa mga bilanggo dahil pagkakataon na nilang pumuslit dahil maygiyera.Biro lang po. weird and dangerous thinking?
