Pity my favorite senator, Nene Pimentel. His pet bill, the Right of Reply Bill, is slowly getting smothered, with the Philippine press now unleashing a torrent of criticism against the proposed legislation and with lawmakers who had initially supported the bill now abandoning it. As they should.
The other day, Pimentel appealed to the press to reason with him, to present to him clear arguments against the bill. Another lawmaker, Kiko Pangilinan, urged journalists to help improve the bill. Journalists, of course, should not take the bait. As I have pointed out in this space weeks ago, the premise of the bill – that news organizations and journalists should publish or air whatever the subject of news or commentary sends in as a form of reply because if they don’t they’d get arrested, fined, shuttered or imprisoned – is way wrong, not to mention unconstitutional. (What would prevent a politician, for example, from refusing to be interviewed and then later claim that his side or reply was not published and so the journalist should be punished?) The moment journalists face Pimentel and the others in the Senate and suggest ways to improve the bill, they would in effect accept the premise of the bill. So the best way to counter it is to reject its premise. This is not to say, of course, that Pimentel did not have valid reasons to author a proposed law that would ultimately usurp the power and responsibilities of journalists, a medicine that has a great potential for becoming worse than the disease it ostensibly intends to cure. If anything, the bill’s existence and the support it got should be a reminder to journalists to be responsible with their power because the state, particularly a repressive one, will always try to exploit the shortcomings of the media in order to control, muzzle or manipulate it . To paraphrase a favorite quote, the answer to bad journalism is not legislation, but good journalism. And I don’t see how the Right of Reply Bill, because it is draconian in many respects, can produce good journalism. On the contrary, it will be the newsroom’s Sword of Damocles. Such an environment of fear can no way foster good journalism. Apart from the wrong premise, my beef against this bill is that it assumes that irresponsible journalism is so widespread in the Philippines that the situation has become hopeless so that a law like this is imperative. Nothing can be farther from the truth. Its licentiousness notwithstanding, the Philippine press remains a functioning tool in our democracy. It has shown its capacity and willingness to check the abuses of those in power, for example. Investigative journalism is something that the Philippine press can be proud of, comparable to, or even better than, the rest in the region. The bill intends to take away from journalists the editorial prerogative and responsibility to determine fact from fiction, the truth from propaganda. It wants the press to become a mere regurgitator of information, whether verified or not. I’m not sure if Pimentel et al realized this but by pushing for this bill, they imperil the very kind of journalism that has helped so-called fiscalizers (among them senators) to expose malfeasance in government. the right of reply bill is the answer to sensationalism and tabloid-dish newspapers, including national dailies and those tabloid news outfits that masquerade as national broadsheet. many times, a national broadsheet newspaper screamed in its headlines a title that catches one's attention (that's the purpose, to sell, come what may) but the body of the story did not carry the screaming headline or title. the right of reply bill is the answer to screaming news anchors, tv and radio commentators who screamed at people they perceived to have to committed wrong. even if these tv and radio commentators did not have an iota of proof. the right of reply bill is the answer to philippine media's sensationalism, whether a broadsheet or tabloid, broadsheet masquerading as tabloid, radio and television purveyors of lies, half-truths and nothing.
senators nene pimentels, joker arroyo, kiko pangilinan, gringo honasan, etc, most be concluded for standing up to the bully that is the philippine media. you see the concerted effort to bully the Courageous 8 in the Senate? every media person has been launching attacks against the right of bill even if their arguments do not hold water at all. if every philippine media outfit is responsible enough, then they do not have to worry about the right of reply bill. but sad to say, many philippine media outfits, tabloid or broadsheet, just churn out lies and chismis clothed as a piece of news. many times a person is libeled in the media, or at least a subject of lies and innuendos in media, but when they send in their rejoinders, these are buried deep in the Dear Editor section, or worse not see print at all. or heard on tv on radio. let us admit it, the philippine media is one gigantic monster that is so selfish and afraid of its own shadow that now every media person is attacking or bullying the Courageous 8 in the Senate. Kudos to senators nene, joker, kiko, gringo, etc., for taking on the bully that is the philippine media. may the right of reply bill become a law. it is a pity presidentiable senator loren legarda allowed herself to be bullied by the philippine media. she legarda does not deserve to be president, she easily is cowed at the drop of an ink! is there a presidentiable that can withstand philippine media's bullying? alas, not one of the presidentiables hav the ball to withstand this bullying. so let us support senators nene, joker, kiko, gringo, etc. continue the right of reply bill! I would imagined she decided not to use his last name when she was campaigning for the vp in last election, thinking that the public may associate her as extremely corrupt" and "not to be truseted" kind of gal. and can someone explain it to me what the "courageous 8" is all about. i am new to this thing. thanks I got immense of news and views from this Blog. This Blog will surely assist lot to those who are in the fields of media and journalism, It is really beneficial to go through this Blog if anybody wishes to proceed in the field of journalism.
Shelly I hate to disagree when you said "standing up to the bully that is the philippine media".
Let's back tract a little bit here in time when during the marcos era. any one coming from the media has to be screened, scrutinized thoroughly and shall i say even sanitized by the press secretary for any news, commentaries, opinions or any thing that has something to do with the way the marcos administration is handling the governmnet. Being a member of any group that actually delivers news and information either in the print media or any radio station in the philippines was like standing in a sea of sharks that one false move, and you will be history. Speaking of which, secretary tatad even went for the whole nine yards to order the gestapo boys to seize, confiscate and arrests those people showing the movie "norma rae" (sally fields) and shut down those theaters showing said movie. The question you are probably asking by now is, what's the point that i am trying to drive at. The point is, there has never been and i guess, never will be a time when the "freedom of speech and of the press" will remain detached from any political power that is, in the philippines. However, during the past ten or fifteen years, the media is now stronger than ever in reporting any excesses or abuse by anyone in private or public trusts. This is good i would imagined, considering they are used to just cower whenever they felt something hitting their head most of the times during the marcos era. The only thing that i could think of of making the media churn some good unadulterated news to the public is to make sure that they police themselves in a way that whoever does some irresponsible acts that could be considered "deviant journalism" must pay the price in doing so. Let's not get ourselves into this whole mess over again, we have gone this far after the marcos years and the media have the "responsibility", i wouldn't say the "power" to convey the news to the public be it good or bad. Sort of giving a "pat on the back" to those media people who do a good job and "castrate those who do not". For all its worth, i think this "right of reply bill" comes from the very same people who couldn't tell if they we're looking at the backside of a cow where the sun doesn't shine. Just a thought. i agree with you. on the other hand, now that the philippine media is free of the marcos legacy of suppression and coercion, we now have a media that is unfettered even in its vulgarity, licentiousness, and irresponsibility. not all of them anyway.
what we are seeing now in the debate on the right of reply bill of sen. nene pimentel is RP media's seeming arrogance, shutting down any argument on the need to have the RRB for the protection of the ordinary filipino masses who, unlike the politicos, can't afford to wage a media campaign. try listening to the radio and hear the commentators or anchors letting out even expletives against RRB proponents. this is pure and simple media arrogance and tyranny. i humbly submit there is no true, real, completely free media. every media outlet is only as free as the personal bias and prejudice of media owners, editors, and reporters. thanks for your contribution. Every once in a while some one working in the media business would turn out to be so arrogant and a bully short of saying that he or she would looked like not being responsible at all.
You've got to realized that not all of those in the media have gone through school in the business. Yes, i couldn't agree with you more that, some are pretty much annoying. Remember Mr Yabut, hope i got the name right. He thought for a while that he is somewhat indestructible, i supposed he was in a way, he was ambushed in broad daylight in manila, sustained several rounds in the body, left for dead and managed to turn around and do the same thing over again. What they called "extra judicial killings" have been around since the time of marcos for crying out loud. And it seems that this is not gonna stop. There has got to be a fine line between reporting good news and taking advantage of being in the media business. Just a thought. “The media,” veteran American journalist Helen Thomas says, “is the go-between, a transmission belt to disseminate facts, figures and policies to a waiting public, explaining what the news means to their readers, viewers, and listeners.”
Ordinary citizens generally do not have regular access to government information. But journalists do. That is why they turn to the media for updates on what their government and the men and women running it are doing. But a right of reply law, which is in the offing, would interrupt that function of the media. How in the world would such a law interrupt media? Only the irresponsible and the incompetent media practitioners will feel the heat, and rightly so. The proposed law is only an enhancement of the citizen's basic rights to defend himself, to confront his accusers, and to seek relief from ACDC pseudo-journalists. Remember media's behavior in the police siege on that hotel occupied by Trillanes one or two years ago? They acted as if they are the law unto themselves!Going by their belief that they have every right to intrude into similar situations, specially if it embarrasses the government, no right of reply law will ever interrupt these so-called journalists and their employers.

Journalists in the philippines are very unethical, i wanted to be one, but journalists here are so biased and they blow things up to a point that it destroys even there own country. example, the "meninggo" scare in baguio, i was there, but bullshit, there was no scare! now, the ebola stuff with pigs, believe me people, this ebola reston has no effect on people. the media is just blowing things up, and some journalists here make their own stories just to write on something.

its no secret that there are a lot of journalists out there making a living out of "freedom of speech." this would be testimony to the fact that sadly, self-discipline within your industry is lacking....were that not the case, this bill wouldnt be necessary, and some of you would then stop behaving like bleeding hearts. You speak of the evils of this bill. Fine. Perhaps, now you could tell us how this could be beneficial? Please dont say that there arent, because the bill would not have come to light if it was a bad one. I'm really truly and honestly inlove with the E B Babe Joyce M. Burgos in Eat Bulaga. Even then.
